General Terms of Sale

These general terms and conditions of sale govern the contractual relationship between Mystère Gourmand, the Organizer of treasure hunts and treasure trails, and any individual or legal entity wishing to take advantage, for its own account or for the benefit of third parties, of the services offered, the Applicant.

Booking a treasure hunt implies unreserved acceptance of these Mystère Gourmand (MG) terms and conditions of sale. These conditions shall prevail over any other general or special conditions not expressly approved by MG.

MG reserves the right to modify its terms and conditions of sale. In this case, the conditions applicable will be those in force at the date of the reservation.

Article I : The Organizer
MG is a new concept of fun tours of Paris. In the form of treasure hunts, these tours are created and organized by a facilitator, registered as a freelance worker under SIRET number 848 543 583 00035. The head office is located at 16 rue Jonquoy 75014 PARIS. He organizes treasure hunts to discover well-known and little-known places in Paris, their history, and to spend a friendly moment over a vegan meal in a restaurant in the visited district.

Article II : Principle of the game
Three days before the treasure hunt, participants are invited to join a WhatsApp group and solve a riddle to find the starting point of the treasure hunt. The meeting place and time will then be confirmed by the organizer in the group. On the day of the treasure hunt, participants are asked to arrive at the agreed time. If a participant is late (up to 30 minutes), this person will be asked to join the group on the way by communicating on the WhatsApp group. Late arrivals of more than 30 minutes will not be accepted.

At the starting point, participants are grouped into a single team and given an envelope containing a riddle. The team must work together to decipher the meaning of the riddle, find the next element hidden by the Organizer, and so on through a neighborhood to the final restaurant. The challenges call on participants' skills of observation, imagination and general knowledge. The items found also contain documentation about the history of the place visited. The Organizer will accompany the team for part of the route, particularly at the beginning and end, and will provide assistance where necessary. When he's not physically with the team, he can be reached on the WhatsApp group.

At the finish line, a souvenir is given to each participant. The Organizer then invites everyone to share a convivial meal in the vegan restaurant where the treasure hunt ended.

Article III : Terms of participation
MG's treasure hunts are open to all individuals over the age of 18. For minors, the game is open to them under the responsibility of their legal representative or guardian, who must be present on site.
Registration to a public treasure hunt may be made individually or in teams. If the participant registers alone or in pairs, and does not explicitly request this when registering, they may be paired up with other participants to form a team.

Article IV : Public sessions

Article IV-I : Registration
The Applicant wishing to register for a public session must do so online on the website, then click on the word BOOK HERE.

The Applicant then selects the district and date they wish to attend. They will select the number of persons, the price, indicate their surname, first name, email address and telephone number, and confirm that they have read and accepted the general terms and conditions of sale presented here. MG is registered under number 848 543 583. In accordance with the law of January 6, 1978, the participant has the right to access, rectify or delete any data concerning them. This right can be exercised online by sending an e-mail to contact@lievretaquin.fr.
They will then validate their information by registering for our tour via our website. As soon as the reservation has been confirmed, a confirmation email containing the time and the district will be sent to the email address given at the time of registration.

Article IV-II : Payment
Prices are quoted in euros. MG reserves the right to modify its prices at any time. The participation will nevertheless be invoiced on the basis of the price in force at the time of booking.
MG does not retain the Applicant's credit card details following payment.

Article IV-III: Conformity
It is the responsibility of the Applicant to ensure that the information on the ticket corresponds to the order. All claims must be made within 48 hours after receiving the ticket by email. No claims will be accepted after this.
In the case of ticket delivery by email, it is the responsibility of the Applicant to ensure that the email has been received and to inform MG if it has not. MG cannot be held responsible if the Applicant is unable to enjoy the event without MG having been informed in advance that the Applicant has not received anything.

Article IV-IV: Handicap
The Applicant will specify to the Organizer the practical requirements according to the handicap within 24 hours of the reservation. In the event that access to the game is not possible due to a lack of infrastructure linked to the course, MG cannot be held responsible.

Article IV-V: Cancellation
In the event of cancellation by the Applicant, the Applicant undertakes to notify the Organizer. No refund will be granted if the cancellation request is made within 72 hours before the start of the game, or after the game. However, if the Applicant cancels up to 48 hours before the start of the game, they may receive a voucher with the value of the session for which they were registered, in order to register for another session.

In the event of cancellation of the service by the Organizer due to a case of force majeure such as war, natural disaster, fire, flood or strikes without notice or a fortuitous event any external, unforeseeable and irresistible within the meaning of Article 1148 of the Civil Code, beyond the control of MG and impeding the achievement of the service, the public session will be canceled or postponed and the participant will not ge granted to argue any prejudice. The Organizer will endeavor to notify participants before the start of the game by email or by telephone if a valid number has been provided. The Participant agrees that MG may use the contact details entered at the time of booking to keep them informed.

Article IV-VI: Refund
No reimbursement will be made for any service interrupted, cut short or not used by a participant for any reason whatsoever. Any delay of more than 30 minutes or no-show is considered as a withdrawal and will not be reimbursed.

Article IV-VII: Time
It is imperative to respect the meeting times indicated on the ticket. If you are more than 30 minutes late, you may be refused access to the treasure hunt.

Article V : Private sessions

Article V-I: Quote request
The Applicant wishing to organize a privatized session can request a quote online on the website. They will then access the form.
The Applicant for a privatized session can also contact MG customer service by email at: contact@lievretaquin.fr , by telephone on 07.66.42.82.93 or by private message on the Instagram account @vegantouristparis. Your request will then be handled by the Organizer.

Article V-II: Payment
The Applicant wishing to privatize a MG treasure hunt must pay for the service at least 15 days before the start of the service. Payment is made by bank transfer.
Prices are quoted in euros and include all taxes. MG reserves the right to change prices at any time. The participation will nevertheless be invoiced on the basis of the price in force at the time the quotation is drawn up.
MG does not store the Applicant's credit card details following payment via the Stripe platform.

Article V-III: Conformity
It is the responsibility of the Applicant to ensure that the information on the quotation corresponds to the order. All claims must be made within 48 hours of receipt of the quotation by email. No claims will be accepted after the service has been rendered.

Article V-IV: Handicap
The Applicant will specify to the Organizer the practical requirements according to the handicap when the quotation is drawn up, or at least within 24 hours of the quotation being drawn up. In the event that access to the game is not possible due to a lack of infrastructure linked to the course, MG cannot be held responsible.

Article V-V: Cancellation
In the event of cancellation by the Applicant, the Applicant undertakes to notify the Organizer as soon as possible. Reservations may be cancelled free of charge 15 days before the departure date of the game.
After this date, cancellation charges apply according to the following scale:
- Between 5 and 15 days before the game date: 25% of the quote.
- Between 24 hours and 5 days before game start date: 50% of quote.
- Less than 24 hours before the date of the event: 100% of the quote.
In the event of cancellation of the service by the Organizer due to a case of force majeure such as war, natural disaster, fire, flood or strikes without notice or a fortuitous event any event external, unforeseeable and irresistible within the meaning of Article 1148 of the Civil Code, beyond the control of MG and impeding the realization of the service, the public session will be canceled or postponed without the participant can argue any prejudice.
The Organizer will endeavor to notify the Applicant as soon as it is aware of these elements by email or by telephone if a valid number has been provided. The Applicant agrees that MG may use the contact details entered at the time of booking to keep them informed.

Article V-VI: Refund
No reimbursement will be made for any service interrupted, cut short or not used by a participant for any reason whatsoever. Any delay of more than 30 minutes or no-show is considered as a withdrawal and will not be reimbursed.

Article V-VII: Time
It is imperative to respect the agreed meeting times. If you are more than 30 minutes late, you may be refused access to the treasure hunt.

Article VI: Withdrawal period
In accordance with the provisions of article L.121-20 of the French Consumer Code, the buyer who purchases a good or service from a professional at a distance has 7 clear days to change his or her mind about the purchase, without having to justify it or pay penalties (excluding any return costs). However, the right of withdrawal does not apply to contracts for the provision of accommodation, transport, catering and leisure services, which are supplied on a specific date or at a specific time. As such, MG services are not subject to this time limit.

Article VII: Litigation and liability
MG declares that it is not responsible for any accidents, for any harm suffered by participants during the event, or for any damage they may cause. Each participant is therefore solely responsible for their participation in the sessions. During the treasure hunt, a telephone number is given to each team in case they need to contact the Organizer.
MG is the owner of the material (envelopes, clues) made available during the treasure hunt. Participants therefore undertake to return all materials to the Organizer at the end of the treasure hunt. Should this not be the case, the Organizer will not hesitate to ask for compensation.
Participation in MG's treasure hunts implies unreserved acceptance of the present rules in their entirety.

Article VIII: Attribution of jurisdiction
The parties agree that this contract is governed by French law.
In the event of a dispute, the parties will endeavor to settle it amicably. Any dispute which cannot be settled amicably will be referred to the competent courts designated in accordance with the French Code of Civil Procedure.

Article IX: Data protection
All personal data collected when registering for a session is processed in accordance with the French Data Protection Act of January 6, 1978. In application of article 27 of this law, participants and their legal representatives, if they are minors, have the right to access or rectify data concerning them. Requests for access, rectification or objection should be sent to contact@lievretaquin.fr.
In addition, the Organizers guarantee the security and protection of the data collected, and in particular that it will not be passed on to third parties.

Article X: Literary and artistic property rights
In accordance with the laws governing literary and artistic property rights, the reproduction, representation or use of all or part of the elements making up these treasure hunt sessions, and in particular the riddles, questions and media, is strictly forbidden, under penalty of prosecution.

Article XI: Image rights
All persons taking part in the treasure hunt implicitly agree to surrender their image rights for any photographs taken during the treasure hunt. If the participant does not wish to transfer their image rights, they must explicitly request this either by e-mail to contact@lievretaquin.fr, or verbally when the Organizer asks for confirmation of the participant's consent to transfer their image rights at the start of the treasure hunt.
